Promotion terms
Plain-language terms for paid promotion on Arcapush. Each campaign also has its own order listing exactly what you get and what it costs.
1. Who the agreement is between
These terms are between BlindspotLab Limited (RC 9855946), No. 3B, Oluwalogbon Close, Igberen, Ota, Ogun State, Nigeria ("BlindspotLab", "we"), which operates Arcapush, and the customer named on the campaign order ("you").
You must be at least 18 and have authority to commit the business or product named on the order, and to supply its name, marks and materials for promotion. You confirm both when you accept an order. A young-builder account cannot accept an order.
Each campaign is governed by these terms together with its campaign order. If the two conflict, the campaign order's specific details (deliverables, dates, price) take priority.
2. What we deliver
The campaign order lists the exact deliverables, the channels they appear on, the placement dates, the duration and the price. We deliver what the order lists, no more and no less, unless we both agree a change in writing (email is fine).
Every paid placement is clearly labelled as promoted or sponsored. Paid placement never changes organic rankings such as Trending, Moving Forward or Editor's Picks, and does not change listing votes or scores.
3. Price, taxes and payment
The order states the price, the currency, whether applicable taxes (such as VAT) are included or added, when payment is due and the agreed payment method. We don't add charges that aren't on the order.
No campaign starts before payment is received unless the order says otherwise. Campaigns do not renew automatically: any further campaign needs a new order.
4. Your materials, permissions and approvals
The order lists the materials you'll supply (for example copy, images, links), the date we need them by, and anything you need to approve before it goes live.
You confirm that you have the rights to everything you supply and that it is accurate, lawful and not misleading. You grant us a limited, non-exclusive licence to use, format and display those materials only to deliver the campaign and to report on it. The licence ends when the campaign and its reporting end, except for copies kept in records we're required to retain.
If materials or approvals arrive late, we'll try to keep the agreed dates; where that isn't possible we'll agree new dates with you. Late materials alone are not a reason for us to keep fees for work we haven't done.
5. Revisions and changes
The order states how many rounds of revisions are included. Changes beyond that, or changes to the deliverables, channels or dates, are agreed separately in writing before they're made, with any price difference stated up front.
6. Measurement and reporting
The order names the measures we report (for example impressions, visits, clicks to your product), how each is defined, the reporting period and when you'll receive the report.
Reported numbers come from Arcapush's own records. They have limits: browsers that block tracking, shared devices and other sites' measurement can count differently, and we can't see what happens on your site after a visitor leaves Arcapush.
7. No guaranteed outcomes
We guarantee to deliver the placements on the order. We don't guarantee any particular amount of traffic, signups, sales, rankings, press or funding, because those depend on many things outside our control.
8. Cancellation, rescheduling and refunds
Before the campaign starts, you can cancel for a full refund, less any non-recoverable costs that were agreed on the order and that we can document (for example a third-party booking we already paid for).
After it starts, you can cancel at any time. We refund the price of every deliverable not yet delivered, worked out in proportion to the order, less agreed and documented non-recoverable costs. Completed work, which we'll show you, is not refunded.
You can ask to reschedule once at no charge with reasonable notice (the order states how much); we'll offer the nearest available dates.
If we can't deliver something on the order, you choose: we reschedule it, or we refund its proportionate price in full. If we deliver less than the order states for reasons on our side, the same applies to the undelivered part.
Refunds go back by the original payment method within 14 days of being agreed.
9. Suspension for unlawful or misleading material
We may pause or end a campaign if its material is unlawful, misleading, infringes someone else's rights, or breaks Arcapush's content rules. We'll tell you why and give you a chance to fix it where that's possible.
If we end a campaign this way, we'll account fairly: we keep the price of what was delivered and documented non-recoverable costs, and refund the rest.
10. Confidentiality
We each keep the other's non-public information (prices, plans, unreleased products, campaign results) confidential and use it only for the campaign, unless the other agrees or the law requires disclosure. Published campaign content is, of course, public.
11. Complaints and disputes
If something isn't right, email hello@blindspotlab.xyz with your order reference. We'll acknowledge within 2 business days and aim to resolve it within 10 business days.
If we can't resolve it together, either of us can escalate it: we'll first try good-faith negotiation between senior people, then mediation, before either of us goes to court. Nothing here stops you contacting a consumer-protection authority or using any other right you have by law.
12. Liability
We're responsible for delivering the campaign with reasonable care and skill. If we don't, our liability for a campaign is limited to the amount you paid for it, except where the law doesn't allow a limit.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer where they apply.
You're responsible for the accuracy and lawfulness of the materials you supply, and for claims that arise because they weren't, to the extent caused by them.
13. General
These terms are governed by the laws of the Federal Republic of Nigeria. If you are a consumer in another country, you also keep any protections the law of your country gives you that can't be overridden by agreement.
